An 18-year-old Pompano Beach man has been arrested on a felony criminal mischief charge after deputies said a blue BMW he was in tore up the Kings Point golf course in unincorporated Delray Beach and ended up in a pond.

Isaac Janieg Rojas Aguilera faces at least $1,000 in property damage, according to a Palm Beach County Sheriff’s Office probable cause affidavit obtained by BocaNewsNow.com. A witness told deputies the BMW was driving recklessly and doing donuts in the parking lot at 6561 Flanders Way, near the Flanders Clubhouse, before it moved onto the course and drove donuts on the grass. The SUV then went into a nearby pond, the witness said. Deputies found circular tire tracks on the course and reviewed cellphone video of the car in the lot.

The crash drew a large rescue response around 6:15 a.m. Palm Beach County Fire Rescue sent rescue swimmers and dive teams into the pond after a bystander reported as many as six people may have been in the vehicle. No one was found in or around the submerged car. The sheriff’s office said in an initial report that three passengers fled, but that claim does not appear in the affidavit.

Deputies found Rojas Aguilera shirtless and holding BMW keys. He told deputies he was in the car when it hit the water but was not driving. His mother told deputies she had let him use the 2022 BMW X3 for work on Oct. 30. He was taken to Delray Medical Center for evaluation after exposure to the pond water and then booked into the Palm Beach County Jail.

The charges are allegations, and the defendant is presumed innocent until proven guilty in court.
