The City of Miami has issued a notice of violation to the developer of The Club at Brickell Bay, saying the building is operating in a way that does not match its certificate of use. The notice was issued this week and follows an August cease-and-desist letter.
City officials found more than 300 vacation rentals advertised in the building, though only 30 short-term rental units are permitted. Residents say the unpermitted stays have crowded lobbies and elevators and disrupted daily life.
The notice was addressed to Brickell Bay Plaza Inc., which holds the property’s certificate of use. Developer Jerome Hollo, the company’s registered agent, said in a statement that the firm controls only the first-floor commercial leasing and that the condominium association is responsible for the residential units. He said the city had cited the 1201 Brickell office building by mistake and expected it to be cleared up quickly. An attorney for the association said the notice was not directed at the association.
Miami District 2 Commissioner Damian Pardo said he plans further enforcement, including a proposed citywide short-term rental registration ordinance and a dedicated task force. Under the notice, continued non-compliance could bring fines of up to $5,000 per day. The city has set Oct. 30 as the compliance deadline, but short-term stays for November dates could still be booked online as of this week.
