A 34-year-old Boca Raton man was arrested Oct. 15 and charged with battery on a person 65 or older, according to Boca Raton police and a probable cause affidavit reviewed by BocaNewsNow.com. The incident took place at a residence in “The Oaks At Boca Raton,” though the exact location has been redacted in the report.

Police said Justin Ryan Heller opened his front door and pushed a man, described in the affidavit as 65 or older, into nearby bushes. The two men then fought again inside the house, where a 5-month-old was present. A witness saw the initial shove, and Ring camera footage showed the push and both men fighting on the ground.

The argument reportedly started over an outing the older man took the night before without Heller’s approval. Heller told police the man insulted his late mother and threatened to fight him, and that he invited him to the home before hanging up. Police documented scratches, a raised bump on the man’s forehead, a torn shirt and dirt on his clothing.

Heller told officers the man later grabbed a baseball bat, and that he went upstairs to a gun he kept in a waist bag and warned he was armed. Heller was booked into the Palm Beach County Jail and released on $7,500 bond. A court date has not been set.

The charges are allegations, and Heller is presumed innocent unless proven guilty in court.
