Riders of e-bikes and motorized scooters will be barred from Miami sidewalks beginning in early November under new rules the city commission approved unanimously on Oct. 22.

The ordinance limits riders to bike lanes where they exist, or to city streets and road rights-of-way posted at 30 mph or less. It sets a 20-mph maximum speed and bars anyone under 16 from operating the devices. Operators must carry valid government-issued photo identification. The rules apply to city-controlled roads, not county or state roads.

Riders may still walk their devices on sidewalks. They cannot park on sidewalks outside designated spots, block entrances or exits, or leave less than three feet of clearance for pedestrians. Carrying more than one person is generally prohibited, though an adult may carry a child wearing a helmet.

Violations carry a $100 civil fine, and each day counts as a separate offense. Riders may also be cited under state traffic laws. Appeals go to a special magistrate. For violations involving a minor, the child or a parent or guardian may receive a warning and safety materials instead.

Commissioner Rolando Escalona sponsored the measure, citing crashes at busy intersections. He said the intersection at 17th Avenue and First Street had seen more than 26 accidents in about a year. Police Chief Edwin Lopez said officers will be able to issue citations, but education will come first. The department plans to expand both education and enforcement in the coming months.

The rules do not apply to wheelchairs or other power-driven mobility devices protected under the Americans with Disabilities Act.
