The estate of a Boca Raton nursing home resident has filed a wrongful death lawsuit against the facility, alleging staff let a severe bedsore worsen until he died. The complaint was filed Oct. 22 in Palm Beach County Circuit Court against Avante at Boca Raton, Inc., which operates Avante of Boca Raton SNF.

Mandana “Mandy” Kalliche Weber, personal representative of the estate of Robert Bernard Kalliche Weber, brought the case. He lived at the facility from Sept. 28, 2023, until he died May 29, 2025. The suit describes him as immobile and dependent on staff for repositioning, hygiene, nutrition and wound care.

According to the complaint, the facility recorded a Stage III pressure ulcer on his sacrum in January 2024. By November, the wound was not healing and bone was visible. He was hospitalized in December 2024, where doctors diagnosed a Stage IV pressure injury with cellulitis. He had debridement and a diverting colostomy later that month.

When he returned to the facility in January 2025, the wound measured roughly 11.5 by 9 centimeters and 2.5 centimeters deep, the suit says. It alleges that from February through May, staff did not consistently assess, measure or document the wound, reposition him or escalate his care to physicians. The filing also claims a reported delay in emergency response during his final decline contributed to his death.

The lawsuit, filed under Florida’s nursing home residents’ rights statute, also accuses the facility of understaffing and inadequate employee training and supervision. The estate seeks damages of more than $50,000 and has requested a jury trial. Morgan & Morgan represents the estate. The allegations have not been tested in court.
