The homeowners association at Delaire Country Club has sued to foreclose on a home at 4572 White Cedar Lane, alleging the owner has gone about two years without paying dues and other fees. The Delaire Country Club Property Owners’ Association filed the suit Friday in Palm Beach County Circuit Court against Hernan Caride Donovan.
According to the complaint, monthly maintenance dues of $5,009 and other charges have gone unpaid for roughly two years. The association recorded a claim of lien on Aug. 24 for $76,223.18 in unpaid assessments. A demand letter sent the same day listed a total of $85,375.29 with interest and legal fees.
The association says interest accrues at 18 percent a year, and the damages now exceed $100,000, even after the owner made some payments. The suit includes counts for foreclosure and breach of contract and asks a judge to order the property sold if the debt is not paid. The HOA is represented by the law firm Sax Sachs Caplan.
The filing contains allegations only, and the claims have not been tested in court. The case is a reminder for Delaire residents and other Florida homeowners that unpaid association dues can lead to liens and, in some cases, a forced sale.
