A 58-year-old Delray Beach man found asleep behind the wheel of his Mercedes on an Interstate 95 exit ramp in Boca Raton has been charged with DUI after blowing more than three times Florida’s legal limit, the Florida Highway Patrol said.

Heriberto Garcia, who lives in the Kings Point senior community in Delray Beach, was arrested Oct. 14 on the northbound I-95 exit ramp to Congress Avenue. A caller reported the black Mercedes swerving across the road around 2:21 p.m. The car eventually stopped in the inside turn lane, blocking the ramp.

When a trooper arrived at 2:45 p.m., Boca Raton Fire Rescue was already on scene. The trooper wrote that Garcia’s speech was extremely slurred and that he nearly fell after stepping out of the car. Garcia told the trooper he had not been drinking, but a Boca Raton firefighter told troopers Garcia had admitted to drinking. Garcia repeatedly lost his balance during field sobriety exercises, the report said.

At the county’s breath alcohol testing facility, Garcia provided samples of .291 and .286. The legal limit in Florida is .08. He was released on a $1,000 bond and is scheduled to appear in court Nov. 19.

BocaNewsNow.com’s unofficial count puts Garcia at the 113th Kings Point resident arrested since 2023, more than any other senior living community in South Palm Beach County, according to the outlet. The charges are allegations, and Garcia is presumed innocent unless proven guilty in court.
